CLIENT AUTHORISATION 

A critical feature of electronic conveyancing systems throughout the world is the means by which transacting parties give their authority to practitioners representing them in completing transactions using the electronic system,including signing registry instruments on their behalf. 

In NECS this is to be a Client Authorisation Agreement between the Subscriber to NECS and  and each Transacting Party making up the Client they are representing in using NECS to complete the transaction.

The Client Authorisation Agreement developed for NECS consists of:

- a form to be completed and signed
- the terms and conditions of the Agreement created by the signing of the form
- a guide to completing the form.

A blank agreement (3 pages) is available here for review.Reviewing a blank Agreement, particularly its attached completion guide, will assist you in road-testing the fillable version.

It is intended that the form can be completed in two ways:

- by filling in the blank form manually before signing it
- by completing the form online before printing it for signing.

A version of the form for filling in online is available here  for road-testing.You will need Adobe Reader 8.1 or later and you can save a copy of the fillable form locally but be aware that it is only a test version and it will become unusable after 30 June 2010.

- did you find it easy to fill in?
- are the instructions clear and sufficient?
- did you understand each of the sections needing to be completed?
- was it clear to you what information you need to fill in?
- is it well set out for easy use?
- did it print clearly for you?
- was it obvious where it is to be signed?
- is the printed size convenient for your paper filing arrangements?
- could you easily scan the signed form for electronic storage?
- etc

The  form and the Agreement it creates are not yet finalised and won’t be until NECS is ready for implementation but it is an important part of the new practices necessary to support NECS.  The National Project Team has endorsed the Agreement subject to a final review in due course.

For implementation, the final version of the Agreement is to be prescribed by each State and Territory Land Registry.  The completion of a transaction in NECS is to require certification that a properly completed and signed agreement has been obtained from the Transacting Party(s).
