Topics Discussed
The meeting discussed the differing perspectives of jurisdictions about Instrument Certification and agreed to refer the matter to the Legal Sub-Group.
The Legal Sub-Group discussed:
• the draft IGA
• the draft paper intended to become the NECL drafting instructions for the PCC
• the draft MOR and MPR.
The Requirements Sub-Group continued its discussion of the functional requirements specific to Land Registry needs and agreed on a strategy to:
• identify common data requirements for Registry Instrument lodgement
• develop common process flow for interactions between Land Registries and NECS.

SPT Meeting 23: Melbourne – 15 & 16 June 2010
Legal Framework Development
Clayton Utz reported on progress with the clarification advice commissioned by the National Office and provided preliminary findings. Delivery of the final advice is expected by 25 June.
CIV Standard and Application Procedures
KPMG briefed the meeting on their approach to negotiating a CIV Standard, presenting an outline of the methodology and timeline and requested all possible assistance in responding to enquiries.
BRCWG Briefing
Representatives from the BRCWG’s E-Conveyancing Sub-Group explained its purpose and priorities emphasizing the importance of the COAG objectives and timeframes and the reason for establishing NECDL.
NECS Release Strategy
Land Registry priorities for a Release Strategy for NECS were discussed and a preferred approach was settled upon made up of three stages.
Sub-Group Meetings
The Legal Sub-Group discussed the draft IGA, a paper intended to become the NECL drafting instructions for the PCC and preparation for the MOR and MPR content development.
The Requirements Sub-Group discussed the functional requirements specific to Land Registry needs and the work that would need to be done to meet those requirements.
Jurisdiction Readiness
NSW reported on its NECS readiness program covering the CT consultancy, business rules development and work on defining electronic lodgment case schemas.
Qld presented its paper on jurisdiction data requirements.

SPT Meeting 22: Perth – 4 May 2010
The Chair of National E-Conveyancing Development Ltd (NECDL), Alan Cameron, addressed the meeting by teleconference. He mentioned that -
• NECDL was being managed by a representative board of directors with only himself as independent of stakeholders
• NECDL has a two-year timeframe to begin electronic conveyancing
• his view is that success for NECDL by end 2011 means limited operation in terms of jurisdictions and transactions
• his view is that stakeholder engagement is NECDL’s greatest challenge
The outcome of a discussion about of Land Registry responsibilities with regard to implementing the legal framework and consistent business practices to support the availability of NECS was the establishment of two further Sub-Groups to complement the existing Legal Sub-Group working on implementing the legal framework for NECS.
The two new Sub-Groups are:
• Requirements Sub-Group, chaired by SA and focused on defining the LR requirements for NECS
• Data Sub-Group, chaired by NT and focused on defining the LR requirements for the NECDS.
Each Sub-Group is to have one representative of each other jurisdiction who is preferably not the jurisdiction’s representative on either of the other two Sub-Groups.
The three Sub-Groups will provide the Land Registries principal contribution to implementation planning.

SPT Meeting 21: Hobart – 10 & 11 March 2010
Revenue Office Collaboration Workshop Three representatives of the state Revenue Offices attended the first day of the meeting to present their agreed approach to duty integration and discuss developing a common jurisdiction data set.
Topics Discussed:
• Legal Framework implementation – discussion of the Clayton Utz advice on Legal Framework Development with the Legal Subgroup to draft questions for the National Office in relation to clarification of certain issues.
• NSW Certificate of Title consultancy
• CIV Standard – further discussion of the Standard acceptable to all jurisdictions with acceptance that the Commonwealth Gold Standard as implemented by Gatekeeper as an example of an acceptable application of previously agreed principles.
NECS Readiness:
• Template for readiness planning discussed further
• Workspace data content with agreement that all jurisdictions develop their data requirements and review the National Data Dealing Transfer Standard requirements compiled by Northern Territory with a view to updating them from paper instruments to electronic instrument requirements.
• Registry Instrument Templates – Victoria distributed a document setting out the specification of its document templates in ECV and all other jurisdictions are to consider what variations may be necessary in their jurisdiction
• Business Rules Development –NSW presented its registry instrument schema work and discussed its transitional approach to Transaction Services
• Consultation – NSW presented its industry consultation paper on Transaction Services

SPT Meeting 20: Melbourne - 28 &29 January 2010
Key Outcomes:
CIV Standard – presentation by Victoria of a paper recommending a minimum standard for CIV with next step for NSW to distribute the Gold Standard and further discuss the issue at the next meeting.
Certificates of Title – NSW presented a progress report on its consultancy to examine options to the CT suitable for both the electronic and paper systems of the future.
Revenue Office Integration – SPT briefed by National Office on discussions with Revenue Offices and Qld agreed to compile a high-level comparison of duty arrangements in each jurisdiction.
NSW presented its draft Legislation Implementation Plan.
Meeting agreed to collaborate in development of the key Land Registry inputs to NECS with Northern Territory to lead work on each jurisdiction’s workspace data content, Victoria to lead work to develop each jurisdiction’s registry instrument templates and NSW to lead work to develop each jurisdiction’s business rules.
Industry consultation – discussion of NSW consultation papers and consultation strategy and NSW’s effective use of key industry stakeholder representatives in consultation forums.

Key Outcomes:
Legal Framework: WA outlined the steps it believed were necessary to implement the legislation component of the expected legal framework for NECS. The Legal Sub-Group is undertaking preparation of a work plan for its development.

Consistent Paper & Electronic Practices: Discussion of each of the practices potentially amenable to consistent treatment in the paper and electronic environments.
Jurisdiction Readiness: NSW updated the meeting on its NECS Readiness activities and presented work on investigating and modelling the potential impacts of NECS on its title search products and income. NSW also presented its work on developing business rules for publication to industry, for use in NECS and for electronic examination of digital instruments, including a demonstration of its rule repository. The jurisdictions discussed their own jurisdiction readiness progress.

SPT Special Meeting : Sydney - 4 November 2009
Key Outcomes:
The SPT held a special meeting at which Clayton Utz presented its latest work on developing a legal framework for NECS and in particular the contents and thinking behind an advance copy of its Fourth Consultation Package dealing with liability and compensation issues.
Substantial discussion ensued on many issues especially the treatment of residual liabilities. Clayton Utz presented an overview of the digital signing process plus its views on an appropriate attribution rule, and stepped through two potential fraud scenarios to demonstrate the respective implications for a strong and a weak attribution rule.

SPT Meeting 18: Adelaide – 13 & 14 October 2009
Key Outcomes:
NECS readiness updates - The jurisdictions provided advice on their NECS Readiness activities. Chair introduced a proposed template developed by SA for regular reporting of NECS readiness progress and meeting agreed that SA would be the reporting custodian, that reporting would be deferred until establishment of NECDL was announced, and that all jurisdictions would provide suggestions to SA on its reporting template.
The Meeting discussed the following topics:
• Consistent approach in paper and electronic systems
• CIV Standard – discussion of principles necessary in a consistent Land Registry approach to an acceptable CIV Standard and Application Procedures
• Lodgment Fee Collection – discussion on the approaches to collecting Lodgment fees in NECS
• Priority Notices – WA discussed its progress with developing an approach to introducing priority notices and advised that it was currently engaged in a legislation review and consultation process.
Workshop on National Approach to Duplicate Certificates of Title – following on from their workshop at the last meeting Tasmania led discussion on the consolidated matrix of possible safeguards against fraud in a no-CT environment which will be further developed with input from each jurisdiction.
Legal Framework Workshop: the third consultation package distributed by Clayton Utz in its Legal Framework Development consultancy was discussed. A range of legislation issues were discussed and positions supported including:
• standard ELNO authorisation format in Model Operating Requirements
• statutory attribution rule
• statutory Supporting Evidence retention period
• authorisation of transaction categories in Model Operating Requirements
• definition of ELNO to allow Land Registry to be an ELNO
• statutory power for Land Registry to audit Subscribers
• statutory clarification of evidentiary status of electronic instruments
• separate enabling legislation in each jurisdiction using the template approach.
It was agreed that NSW would coordinate development of SPT feedback to Clayton Utz and that a special meeting would be held on 4 November to consider the consultation package.
Consistent Approach to Registry Information Services: the meeting considered the NECO paper reporting the results of a survey of title search services and intentions. The opportunity for collaborative work now while most jurisdictions were developing XML title search services was stressed, as was the efficiency benefits to NECS and to industry of a consistent approach to Registry Information content and supply. The meeting agreed to provide NECO with a representative for a representative for a Technical Sub-Group to collaborate on a standard approach to web services provision of XML title searches.

SPT Special Meeting: Melbourne – 17 September 2009
The SPT held a special meeting with Mark Sneddon, David Kreltszheim and David Kwong of Clayton Utz to review with Clayton Utz some of its recommendations for the legal framework intended to secure the confidence of all stakeholders in the operation and use of NECS.
As well as the materials already distributed in a consultation package Clayton Utz supplemented its presentation with draft content of Model Participation Rules, how documents are signed digitally using PKI technology and the nature and importance of an attribution rule for digital signings.
Clayton Utz advised that together with liability and compensation arrangements, the Model Participation Rules including an attribution rule for digital signings are to be the subject of a further consultation package to be distributed mid-October.
The Chair invited each jurisdiction to report on its legislation readiness for NECS with particular emphasis on developing technology-neutral legislation suited to both paper and electronic environments.

SPT Meeting 17: Brisbane – 18 & 19 August 2009
Key Outcomes:
o Issues Papers – The SPT was advised of the resolutions reached by the NPT on settlement disbursements and transaction assurance. The SPT members agreed that the Lodgment Acceptability Assurance (LAA) is better expressed as Lodgment Acceptability Advice and the Title Activity Check (TAC) is to be provided by NECS polling the Land Registry system. The position reached by the NPT was discussed and the existing legislative constraints on full implementation in SA and Qld were recognised.
o Transaction Scope – SA presented the results of survey of caveat and caveat withdrawal incidence, practices and issues resulting in agreement that purchaser’s caveats and all caveat withdrawals can be included in the minimum transaction scope for NECS.
o Fee Invoicing and Payment Collection – Qld presented a paper and after discussion it was agreed that:
Payment methods to be available in NECS have already been determined by the NPT
Collection method issue related only to Lodgment Fees
Collection of Lodgment Fees by NECS and subsequent bulk payment to Land Registry was generally preferred with only Vic reserving its position.
The SPT needed to further consider how the collection of Lodgment Fees by NECS and their payment to Land Registries should be arranged.
o NECS readiness updates - The jurisdictions provided advice on their NECS Readiness activities.
o Workshop on national approach to duplicate certificates of title – discussion focussed on the role of the CT in the conveyancing process from both the Land Registry and industry perspectives. A common view was not reached. The meeting agreed that the objective of further work on this is would be “If paper duplicate CTs are removed, what mechanisms are necessary to maintain the integrity of concurrent electronic and paper-based conveyancing.” It was agreed that the work to be commissioned by the National Office to negotiate a CIV standard and Application Procedures among key stakeholder groups was critical to the discussion on duplicate CTs.

The meeting also considered the issues of operational roles, transaction scope, workspace creation, workspace population, transaction assurance and lodgment acceptability.

o Workshop on national approach to duplicate certificates of title – The meeting included a half day workshop on role of duplicate certificates in NECS and control of the right to deal.

SPT Meeting 14: Sydney – 17 & 18 March 2009
Key outcomes:
• Issue Papers – The meeting finalised SPT positions on the issue papers to go to the National Project Team. Topics covered by the papers included: mortgage counterparts, chain settlements, fee payments, settlement disbursements and document signing. The meeting also held further discussions on consistent business practices.
• NECS Requirements Definition (NRD) – The meeting involved further work detailing Priority One function requirements for the jurisdictions defined in the NRD.
• Legal Framework – The meeting included a half day workshop on the NECS legal framework. The workshop focussed on the legal arrangements needed to enable an electronic lodgment network within the jurisdictions. Western Australia led discussion on potential legislative requirements from its legislation environment review. Clayton Utz representative, Mark Sneddon, gave an overview of the work involved in the legal and governance framework consultancy.
• NECS Readiness Programs – The meeting also received an update of jurisdiction readiness planning.

SPT Meeting 11: Sydney – 11, 12 & 13 November 2008
Key outcomes:
• NECS Requirements Definition (NRD) – Day One was dedicated to reviewing Priority One NRD functionalities. NRD functionalities had been prioritised according to the relevance to the land registries.
• National Practice and Documentation Issues – Day Two was allocated to progressing National Practice and Documentation Issues, with issues previously canvassed considered in more detail.
• NECS Legal Framework: Day Three considered the NECS legal framework and legislative requirements. The National Office noted that it was important to specify a clear purpose, develop performance objectives with stakeholder groups and use the agreed performance objectives to determine the optimum components of the framework. It was agreed that reviews of current legislation were a priority for the jurisdictions.

SPT Meeting 10: Melbourne – 16 & 17 September 2008
Key outcomes:
• Control of the Right to Deal – The meeting opened with a Control of the Right to Deal workshop led by Queensland. This resulted in agreement to:
o further consider a national approach to duplicate Certificates of Title (CT)
o produce a draft national approach to Priority Notices (PN) for further consideration.
• National Documentation Issues – In relation to National Documentation issues, the meeting:
o agreed to provide feedback on the National Office’s draft template for a national Client Authorisation (CA) form
o agreed to work towards a consistent approach to Supporting Evidence (SE) requirements
o discussed the National Office’s process diagrams of Fee Invoicing and Payment Methods (FIPM) and alternatives as a means of clarifying issues and options.
• Issues Register – The National Office made a presentation on the NECS Issues Register which is published on the NECS website. The meeting agreed that an SPT Issues register should also be established and maintained.
• Digital Signature Certification – The National Office presented an issue paper incorporating advice from Clayton Utz on Digital Signature Certification. The advice was considered in the context of the full NECS Risk Assessment. The meeting also discussed the principle issues relating to the signing of mortgage counterparts.
• NECS functionalities – The meeting discussed NECS functionalities such as workspace creation, population, validation, and verification and lodgment acceptability checks. Jurisdictions presented their various positions and agreed on a process for further consideration of these issues.

SPT Meeting 9: Brisbane – 5 & 6 August 2008
Key outcomes:
• NECS Requirements Definition (NRD) – The meeting made considerable progress towards describing NECS requirements by focussing on essential business requirements from a land registry perspective. It resulted in a collective SPT view to be used by the National Office to update the NRD.
• Consistent Business Practices – The meeting considered the Independent Expert Advice obtained from Clayton Utz on the appropriate level and means of business practice prescription. The meeting agreed the advice was relevant and useful.
• National Documentation and Practice Issues – Work on National Documentation and Practice issues continued with the jurisdictions agreeing to provide information regarding current financial accounting processes to assist in developing preferred arrangements for NECS.

SPT Meeting 8: Darwin – 3 June 2008
Key outcomes:
• SPT Charter – The SPT agreed on its Charter, which sets out its purpose, composition, procedures and commitments.
• National Requirements Grid – Western Australia presented a draft National Requirements Grid and the meeting agreed to use it as a means of collecting draft requirements from the land registries.
• Business Practices – The meeting continued its consideration of National Documentation and Practice issues including Client Identity Verification (CIV), Client Authorisation (CA), Instrument Certification (IC) and Supporting Evidence (SE) requirements. It resolved that it was important to involve the National Project Team as soon as possible in settling nationally consistent business practices.

SPT Meeting 7: Hobart – 1 & 2 April 2008
Key outcomes:
• SPT Issues – The meeting agreed that:
o a Charter would assist in guiding the SPT’s activities in the future and it was resolved that a draft charter be considered at the next meeting
o the SPT should meet at least six times each year, with future scheduling having regard for NPT deliberations
o one jurisdiction member on the NPT was sufficient to represent the interests of all jurisdictions in the matters considered by the SPT.
• NSW NECS Readiness Program – NSW presented an overview of its NECS Readiness Program and explained its business case for participating in NECS.
• Tasmanian On-Line Dealings (TOLD) – Tasmania demonstrated the Tasmanian On-Line Dealings (TOLD) system. The meeting noted the system’s useability and cost-effectiveness, as well as its substantial take-up in Tasmania.
• NECS Requirements Definition (NRD) – The draft NRD, circulated in June 2007, was agreed as the basis for documenting jurisdiction requirements of NECS. Jurisdictions were invited to consider whether the NRD covered all the functionalities required in NECS. Western Australia offered to develop a common requirements documentation template to be tested by Victoria and NSW before adoption at the next meeting.
• National Documentation and Practice Issues – The meeting confirmed the previously agreed principles to govern development of a consistent approach to business practice requirements for Client Identity Verification (CIV), Client Authorisation (CA) and Instrument Certification (IC). Further discussion was held on the implementation of these business practices.
• Control of Right to Deal – The meeting discussed the issue of control of the right to deal. NSW and Queensland agreed to prepare a comparative summary of the positions among the jurisdictions. The National Office was tasked with researching overseas experience with regard to the right to deal in electronic conveyancing environments.
• Fee invoicing and payment collection – The meeting raised the issues of fee invoicing and payment collection. It was resolved that the jurisdictions review their current processes in readiness for further discussion at the next meeting.

SPT Meeting 6: Melbourne – 10 December 2007
Key outcomes:
• Consistent Business Practices: The meeting confirmed the draft principles discussed at length at the previous meeting. These draft principles will be used to guide development of a consistent national approach to business practice requirements for Client Identity Verification (CIV), Client Authorisation (CA) and Instrument Certification (IC).
The discussion then turned to how each of the business practice requirements should be implemented. The SPT resolved to develop consensus among the jurisdictions over the next few meetings on what is required and how it should be put into place, incorporating detailed consideration within each jurisdiction.
• Requirements Assessment Methodology: Prior to the meeting, Queensland provided the National Office with a revised Requirements Assessment Methodology. The National Office did not accept that the revised methodology adequately incorporated the process agreed to at the last meeting. The methodology was supposed to provide jurisdictions with a definition of their individual and collective system requirements of NECS and also provide indicative costing of changes necessary for ECV to satisfy the jurisdictions' collective system requirements.
With the exception of Victoria and Queensland, the meeting agreed on amendments to the National Office’s Requirements Assessment Methodology, which would require final endorsement from each jurisdiction prior to implementation.

SPT Meeting 5: Canberra – 2 November 2007
Key outcomes:
• NECS legal framework: The meeting was presented with an overview of the proposed NECS legal framework, which was with the jurisdictions for comment. Victoria undertook to provide the National Office with its comments in light of their experience in developing similar arrangements for ECV.
• Consistent Business Practices: The meeting focused on discussing principles that would underlie a consistent national approach for business practices such as Client Identity Verification (CIV), Client Authorisation (CA) and Instrument Certification (IC). These issues were identified during the initial consultation phase as being of critical concern to stakeholders in the development of NECS. It was agreed by the meeting that the draft principles would be further reviewed by jurisdictions prior to its next meeting.
• Requirements Assessment Methodology: Queensland provided a paper entitled ECV Assessment Methodology. The paper proposed a methodology to assess the cost effectiveness of modifying the ECV to meet the requirements of other jurisdictions. The meeting confirmed the importance of the methodology as a means to help each jurisdiction determine their system requirements for NECS. It was resolved that Queensland update the methodology in light of the process agreed by the meeting and bring the revised methodology to the next meeting for formal approval. The methodology would then be applied by the jurisdictions and coordinated by the National Office in the context of the NECS Roadmap.

Key outcomes:
• Consistent Business Practices – The meeting discussed the development of a series of principles consistent with effective risk management in agreeing approaches on Client Identity Verification (CIV), Client Authorisations (CA), Instrument Certification (IC) and legal framework.
• NECS Requirements Definition (NRD) – The meeting involved considerable discussion on the NRD process, with the process proposed by National Office agreed by all jurisdictions except Queensland. It was agreed that the Victorian electronic conveyancing system (ECV) should be used to assist in the development of the NRD requirements once ECV is transferred to NECS.

SPT Meeting 3: Adelaide – 8 May 2007
Key outcomes:
• SPT Issues: As a result of the decisions of the National Steering Committee meeting in March 2007, the SPT needed to reassess its role. It was agreed that the key function of the SPT is to assist in the task of jurisdiction readiness for NECS. Team members can also assist each other in the key areas of development for each jurisdiction, including defining jurisdictional requirements, considering legal framework issues, technology and procedural issues.
• Business Practices: The meeting agreed on processes to consider whether a consistent approach could be found to some business practice issues such as Client Authorisation (CA) and certification templates.

SPT Meeting 2: Perth – 3 October 2006
Key outcomes:
• National Office Activities: The meeting was given an update on National Office activities including the commissioning of Independent Expert Advice and the ECV Alignment Review, as well as the presentation to Standing Committee of Attorneys General (SCAG).
• Independent Expert Advice: The meeting was addressed by the consultants commissioned to provide the National Office with independent expert advice, including a Risk Assessment, Regulatory Review and Ongoing Governance Arrangements for NECS.
• Victorian Electronic Conveyancing (ECV) System: The meeting was presented with a progress report on the ECV by Rick Dixon.
• Business Practices: The meeting discussed several Notes for National Uniformity in-depth, including:
o Note 1 – Accreditation of certifiers
o Notes 4 & 5 – Client Identity Verification (CIV)
o Note 6 – Client Authorisation (CA) templates
o Note 8 – Use of Certificates of Title (CT)
o Note 9 – Wordings of Instrument Certificates (IC).
The meeting also noted that forms rationalisation was a national issue with parallels to NECS.
• National Electronic Conveyancing Data Standards (NECDS): The meeting discussed the development of NECDS in agreement with LIXI.

SPT Meeting 1: Adelaide – 2 August 2006
Key outcomes:
• State and Territory project team representatives met to discuss areas for possible national uniformity, set out in the NECS Operations Description.
• It was resolved that the team representatives meet again in October 2006 to consider a range of matters including:
o accreditation of certifiers
o Client Identity Verification (CIV) procedures
o Client Authorisation (CA) templates
o future use of Certificates of Title (CT) in an electronic environment.
