National Consultation





Our Initial Approach to Consultation

Consultation with stakeholders is an essential element of the development of NECS.  It is imperative that NECS is a system that meets the needs of industry users and is developed with their active involvement.  This approach is evident in the structure of the National Steering Committee which includes representatives from the jurisdictions together with all major stakeholders.

The National Governance Arrangements (NGA) agreed among all key stakeholders at the outset contemplated a number of national consultation forums for the purposes of engaging government and industry stakeholders in the process of designing and implementing the detail of all arrangements necessary to implement NECS.  However, logistical difficulties arose with this approach and it was decided to implement national consultation through:

  • Publication of a regular newsletter (NECSpress) to keep all interested stakeholders aware of developments and inviting them at any time to bring issues or concerns to attention.
  • Roadshows in each State and Territory to acquaint stakeholders with what was intended.
  • Addition of the NECS Operations Description (NOD) to the National Roadmap
  • An online discussion forum open to anyone with a legitimate interest in conveyancing.
  • Open forums in each State and Territory for stakeholders to discuss issues and debate concerns.
  • An opportunity for industry stakeholder groups to comment locally (and nationally) on the issues being discussed among the jurisdictions in their State Project Teams.
  • Inclusion of extensive stakeholder consultation requirements in independent consultancy work on risk assessment, regulation and ongoing governance arrangements.
  • Presentation of the findings of independent consultancy work and key developments in the National Roadmap generally to a Stakeholder Working Group of national industry and government representatives.

This approach has meant that the National Office is engaging with the widest possible diversity of industry and government opinion on electronic conveyancing about what it should be.

Progress Report on National Consultation

Our initial report on consultation was published in March 2007 as the Progress Report on National Consultation.  
 
The key findings of this consultation are:

  • The National Business Model is sound in its presentation of a definitive and inclusive proposal for electronic conveyancing in Australia
  • The prescription and application of procedures for verifying the identity of transacting parties is the most important procedural requirement associated with the use of NECS
  • There is much more that needs to be explained, explored and resolved about the detailed operations of NECS and its integration with industry practices in each jurisdiction

The progress report highlighted areas that needed to be considered further.  Themes in evidence in our consultation show the importance of:

  • System security and procedural rigour together with
  • Effective risk management and
  • Flexibility in processes and arrangements to meet the requirements of the users

Our approach to consultation has been to obtain views from a wide range of stakeholders as it is our intention to develop a system that industry wants to use and, at the same time, does not compromise the integrity of the Land Registries.

So comprehensive and continuing engagement with stakeholders in design and implementation of the NECS and its surrounding procedures and practice protocols is essential for a successful outcome for all industry participants.

As we progress with the development of NECS more detailed issues must be resolved.

STATE PROJECT TEAM

The State Project Teams (SPT) is leading consultation within each jurisdiction to develop consistent approaches on National Documentation and National Practice issues.  This will provide industry stakeholders with a basis for consideration of their needs.

In December 2007 the SPT agreed on draft principles underlying the business practices for client identity verification, client authorisation and instrument certification.  The SPT is also considering implementation issues.  An important piece of work being undertaken by the SPT is development of jurisdiction requirements of a national electronic conveyancing system.  The NECS Requirements Definition (NRD) is being used to define these requirements.

NATIONAL PROJECT TEAM

In February 2008 an open meeting of stakeholders was held in Canberra to canvas views of the participants on how to set up a National Project Team (NPT).  To view the outcomes of this meeting please click here.  To view the members of the NPT please click here.  The NPT will continue to meet regularly to consider industry requirements of a national electronic conveyancing system.

It is intented that the SPT and the NPT will work in collaboration with the chair of the SPT being the jurisdiction representative on the NPT.  Both report to the NSC

OTHER INITIATIVES

Consultation and development of detail require input from many areas.  In addition to the work of the SPT and the NPT, independent advice has been obtained on risk assessment.  Consideration of risk issues is ongoing as the detail of NECS is being developed.  Another initiative is the work being done in conjunction with LIXI and NICTA to develop national electronic data standards.  Development of data standards consistent with conveyancing industry practice is crucial in a system that is to be industry compatible.
